4. ACCEPTABLE USE POLICY
Any VISITORS found in violation this AUP may have their access to SERVICES suspended or terminated. In extreme cases, at our sole discretion, legal action may be taken against specific VISITORS and/or companies that VISITORS officially represent. We may also warn VISITORS and remove or edit content that violates this AUP. Following are items which violate our AUP:

Illegal Use – Using SERVICES to transmit any material via e-mail, uploading, posting, or in any other method of communication (“TRANSMIT”) that in any way violates local, state, national or international laws, rules, or regulations.

Harm – Using SERVICES to harm, or in any way attempt to harm another person.

Threats – Using SERVICES to TRANSMIT any material that threatens or encourages in any way bodily harm or destruction of property.

Harassment – Using SERVICES to TRANSMIT any material that harasses any person.

Fraudulent Activities – Using SERVICES to make fraudulent offers to buy or sell products, items or services, or to advance any type of financial scam.

Forgery or Impersonation – Adding, removing or modifying identifying information (HTTP headers, browser information, IP address [spoofing], or any other information which may identify where you are “coming from”) (“MOD-INFO”) in an attempt to deceive or mislead BINNEWS is prohibited. Attempting to impersonate any person by MOD-INFO is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation.

Unauthorized Access – Using, or attempting to use SERVICES to access, defeat, or attempt to defeat security measures in place on our, or any other entities computer software, hardware, electronic communications, or telecommunications system.

Copyright or Trademark Infringement – Using SERVICES to TRANSMIT material that infringes any copyright, trademark, patent, trade secret or any other protected property of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

Personal Data – Using SERVICES to collect or attempt to collect personally identifiable information about another person or third party without their knowledge or consent.

Reselling – Reselling SERVICES without prior authorization from BINNEWS prohibited.

Network Disruptions – Using SERVICES for any activity which disrupts SERVICES or VISITORS access to SERVICES. Any activities which may cause network disruption (including Denial of Service attacks, password cracking attempts, port scanning, or excess packeting) against our server or other hosts/nodes on another network is prohibited. It is VISITORS responsibility to ensure their network is configured in a secure manner. VISITORS may not permit their network to be used for illegal, inappropriate, or disruptive actions.

Forums – VISITORS should use best judgment when posting comments to SERVICES, especially the Binnews Forums. VISITORS must read and comply with the rules in place at the time they post. Forum rules can be found within every category in the Binnews Forums.

Multiple Logins – VISITORS using personal accounts for high-volume or commercial use is prohibited. Sharing account information is strictly forbidden. BINNEWS actively monitors all accounts for this activity.

All content in SERVICES, with the exception of VISITORS comments in the Binnews Forums, is owned and copyrighted by binnews.com. Copying of our copyrighted content for any use, without prior express consent is prohibited.

In the event of serious legal action against BINNEWS, horrific earthquake, big bad tsunami, evil locust storm, or other bazaar act of god, BINNEWS shall reserve the right to discontinue SERVICES without notice. With any kind of luck this will never happen. We’ve been kickin’ it since 1999.

5. REPORTING AUP VIOLATIONS
BINNEWS will do its best to make sure all VISITORS comply with this AUP, however if you believe there is a violation of this AUP, please send as much of the following information to staff [at] binnews.com:

• As much pertinent information (URL, location on site, etc.) as possible regarding the alleged violation.
• The date and time (in GMT, or specify time zone) of the alleged violation.
• Evidence of violation (please site in e-mail what content you believe to be in violation)

When BINNEWS receives notice of a violation of this AUP appropriate action will be made to correct violating content.

6. REVISIONS TO THIS ACCEPTABLE USE POLICY
Binnews reserves the right to, at any time, revise, amend, or modify this AUP our other policies and agreements. Notice of any revisions, amendments, or modifications will be posted.
