Texas Governor Threatens To Sue Over Law Requiring All Children Be Educated

Texas Governor Greg Abbott announced Wednesday (May 4) that his administration is considering filing a lawsuit against the US over the Supreme Court ruling that requires states to educate all children, including children who are undocumented immigrants.

"Texas already long ago sued the federal government about having to incur the costs of the education program, in a case called Plyler versus Doe," the Republican said in an interview.

"The Supreme Court ruled against us on the issue about denying, or let's say Texas having to bear that burden."

The 1982 Plyler v. Doe case ultimately rejected the attempt to deny funding used for educating children who are undocumented. Abbott said he's thinking about bringing the case back to the high court.

"I think we will resurrect that case and challenge this issue again, because the expenses are extraordinary and the times are different than when Plyler versus Doe was issued many decades ago," Abbott said.

Abbott is currently seeking re-election and has made several moves against immigration in the state including sending a bus full of people to Washington D.C. last month. The Republican governor also issued stricter inspections at the border, which opponents and experts say drove inflation at Texas grocery stores.

His comments come in the wake of a leak of a draft opinion from the Supreme Court that would overturn Roe v. Wade –– a move many abortion rights advocates warned about in that legal precedent used to potentially revoke the right to an abortion could spill over into other rulings.
