Former Baltimore City State’s Attorney Marilyn Mosby’s mortgage fraud conviction has been dismissed after federal prosecutors decided not to retry her, allowing her to keep the Florida vacation home at the center of the case. Her two federal perjury convictions, however, remain in place.

According to WBAL-TV, prosecutors decided not to retry Mosby after the Fourth U.S. Circuit Court of Appeals overturned her mortgage fraud conviction in July 2025. The appeals court found that the trial judge gave jurors incorrect instructions about where the alleged crime occurred.

Mosby was convicted of mortgage fraud in February 2024 after prosecutors accused her of misrepresenting the source of $5,000 used toward the purchase of a Florida condo to obtain a more favorable mortgage rate. She maintained that the money was a gift from her then-husband, former Baltimore City Council President Nick Mosby.

In a statement posted Wednesday (October 14), Mosby said she was grateful that the “painful chapter” of her life was finally over and that her mortgage fraud conviction had been “rightfully reversed and vacated.”

“This playbook didn’t work. Despite the attempts to discredit me and dismantle my career, I am still standing,” Mosby wrote.

“While I celebrate this victory, another fight remains: protecting and retaining my law license,” she continued. “I will continue that fight with faith, resilience, and the unwavering belief that truth and justice will prevail.”

Mosby’s two federal perjury convictions stem from prosecutors’ allegations that she falsely claimed she experienced financial hardship because of the COVID-19 pandemic to withdraw $90,000 from her city retirement account in 2020.

The federal CARES Act allowed eligible individuals experiencing pandemic-related financial hardship to withdraw retirement funds without the usual 10% early-withdrawal penalty.

The Associated Press reported that she used the money to purchase two vacation properties in Florida.

A jury convicted Mosby of both perjury counts in November 2023. WBAL-TV reported that the U.S. Supreme Court declined to review those convictions on October 5, leaving them in place.

Mosby served as Baltimore’s top prosecutor from 2015 to 2023.
