The widow of Rayshard Brooks has filed a lawsuit against the city of Atlanta and several officers in the Atlanta Police Department.

According to The Atlanta Voice, Brooks’ wife, Tomika Miller filed the lawsuit on behalf of her late husband’s estate and accused the department of a “senseless and unjustified” killing. Miller also says officers did not offer the 27-year-old the necessary medical attention when they arrived on the scene at a Wendy’s restaurant parking lot.

Miller names officers Garrett Rolfe and Devin Brosnan in the lawsuit and claims the latter threatened Brooks with a Taser despite not having completed a mandatory Taser certification course.

Rolfe, who is facing charges related to Brooks’ death, was brought back on the APD after successfully appealing his June 2020 termination days after Brooks’ killing. The department noted that the decision to rehire Rolfe wasn’t based on whether he violated policy, but because the city did not follow protocol in delivering his termination.

The lawsuit also names the City of Atlanta as being culpable in Rayshard’s death for failing to adhere to training protocols and a lack of supervision of officers.

Brooks and Miller had been married for eight years and were raising four children together.
