Man Who Yelled Racial Slurs, Punched Black Food Truck Owner Gets 36 Months

An Oregon man who shouted racial slurs while repeatedly punching a Black food truck owner has been sentenced.

On Wednesday (February 21), Daniel Thomas Warren, 40, was sentenced to 36 months in prison in connection to the June 2023 attack on LoRell’s Chicken Shack owner Darell Preston, per KTVL.

Police said Warren repeatedly punched Preston even after he fell to the ground. Warren also spewed racial slurs during the attack on June 15, 2023, near Southeast 52nd Avenue and Foster Road.

Warren was charged with one count of assault in the third degree and one count of bias crime in the first degree, for which he faces 30 additional months. Warren pled no contest to bias crime earlier this month.

Before the 30-month mark, Warren is required to complete various programs and assignments on anti-bias education. The bias crime charge will be dropped if Warren meets the requirements. If not, Warren will face a presumptive sentence of 25 to 30 months in prison.

Preston's wife, Marshnique Preston, presented a statement on behalf of her husband in court on Wednesday.

"After being attacked by Daniel, I now look over my shoulder three or more times everywhere I go, which aren't many places or even that often anymore. I won't even sit with my back facing the exits at a restaurant, afraid of the unknown or what's behind me," Preston said.
