Rep. LaMonica McIver says her ongoing federal criminal case won't stop her from representing New Jersey's 10th Congressional District.
During a conversation with the Black Information Network at the Congressional Black Caucus Foundation's Annual Legislative Conference, McIver discussed her legal fight, congressional oversight, small businesses and challenges facing Black women.
McIver faces federal charges stemming from a May 2025 confrontation outside Delaney Hall, an immigration detention facility in Newark, where she was participating in a congressional oversight visit. She has pleaded not guilty.
In August, a divided federal appeals court rejected McIver's effort to dismiss two counts based on legislative immunity and separation-of-powers arguments. The court also dismissed her appeal involving another count for lack of appellate jurisdiction at this stage.
McIver maintains that the prosecution is politically motivated and intended to discourage members of Congress from conducting oversight of the Trump administration. Her attorneys have continued to dispute the charges and said they are evaluating their next legal steps.
Despite the case, McIver said she remains focused on her work in Congress. She serves on the House Small Business and Homeland Security committees and has worked on bipartisan legislation aimed at expanding resources and opportunities for small businesses.
McIver also discussed her second annual "Ladies First" panel at ALC, which centers Black women in business. She raised concerns about economic and health disparities affecting Black women and emphasized the importance of organizing and protecting community power.
Looking ahead, McIver said lowering costs for families remains among her priorities, pointing specifically to housing and other household expenses.
